Terms of Service

1. Agreement to Terms

By accessing or using Pogton Technologies' ("Pogton," "we," "our," or "us") website at pogton.com or purchasing our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you may not use our services.

2. Our Services

Pogton provides the following services:

• Tech Consulting — senior-level engineering consulting including full-stack development, architecture, AI/ML integration, and technical strategy, billed hourly
• Managed Website Packages — professionally built and fully managed websites including hosting, SEO, and ongoing support, billed monthly

Specific deliverables, timelines, and pricing are agreed upon in individual project proposals or service agreements.

3. Accounts and Access

Certain areas of our website or services may require you to create an account. When doing so:

• You must provide accurate and complete information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access at anton@pogton.com
• You may not share your account or use another person's account

4. Payments and Billing

Payments for our services are processed securely through Stripe. By purchasing services, you agree to:

• Provide valid payment information
• Authorize recurring charges for monthly website packages until cancellation
• Pay all applicable fees as outlined in your service agreement

All prices are listed in Swedish Kronor (SEK) and are exclusive of VAT (25%) unless otherwise stated. Invoices are issued in accordance with Swedish invoicing regulations.

5. Managed Website Packages

For managed website packages specifically:

• The base package starts at 2,999 kr/month (ex. VAT) with a minimum contract length as agreed
• The website, its code, and design remain Pogton's intellectual property during the contract period
• Domain registration costs are separate unless an existing domain is provided
• We provide hosting, SSL, analytics, and ongoing maintenance as part of the package
• Cancellation requires written notice as specified in your service agreement

6. Intellectual Property

All content on pogton.com, including text, graphics, logos, and software, is owned by Pogton Technologies and is protected by Swedish and international intellectual property laws.

For consulting engagements, intellectual property ownership of deliverables will be defined in the individual project agreement. Unless otherwise agreed, code written as part of a consulting engagement is transferred to the client upon full payment.

7. Acceptable Use

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity of our services
• Reproduce, distribute, or create derivative works from our website content without permission

8. Limitation of Liability

To the maximum extent permitted by Swedish law, Pogton shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services. Our total liability for any claim shall not exceed the total amount paid by you to Pogton in the 12 months preceding the claim.

9. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time. For managed website packages, we will provide reasonable notice before any material changes that affect your service.

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice, if you breach these Terms. Upon termination of a managed website package, the website will be taken offline unless a transfer arrangement has been agreed upon.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes arising from these Terms or your use of our services shall be resolved by the Swedish courts. For consumers residing in the EU, mandatory consumer protection laws of your country of residence apply.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
